Truck Company Responsibility

Operating a trucking company is a huge responsibility. Tractor trailer rigs are heavy and difficult to operate. Add in a tired and/or fatigued truck driver and you have a potentially deadly combination. The Federal Motor Carrier Safety Regulations provide the rules and regulations truck companies must follow. These regulations have been enacted to prevent Missouri truck accidents and keep us safe while driving on our nation’s roadways.

What responsibilities does a Motor Carrier have, regarding knowledge of the Federal Motor Carrier Safety Regulations?

FMCSR 390.3 General applicability.

390.3(a) states the rules in subchapter B of 390.3 are applicable to all employers, employees, and commercial motor vehicles, which transport property or passengers in interstate commerce.

Again, you can see from 390.3(a), applicability of the Federal Motor Carrier Safety Regulations is broad. They are meant to cover as much of the trucking industry as possible.

The Federal Motor Carrier Safety Administration has created the Federal Motor Carrier Safety Regulations (FMCSRs). This is an extremely detailed list of rules that govern the tractor trailer industry. To understand the FMCSRs, you need to understand some basic terminology.

What is a Motor Carrier?

FMCSR 390.5 defines a Motor Carrier as a for-hire motor carrier or a private motor carrier. A motor carrier includes the carrier´s agents, officers and representatives as well as employees responsible for hiring, supervising, training, assigning, or dispatching of drivers and employees concerned with the installation, inspection, and maintenance of motor vehicle equipment and/or accessories.
