Truck Company Responsibility

Operating a trucking company is a huge responsibility. Tractor trailer rigs are heavy and difficult to operate. Add in a tired and/or fatigued truck driver and you have a potentially deadly combination. The Federal Motor Carrier Safety Regulations provide the rules and regulations truck companies must follow. These regulations have been enacted to prevent Missouri truck accidents and keep us safe while driving on our nation’s roadways.

What responsibilities does a Motor Carrier have, regarding knowledge of the Federal Motor Carrier Safety Regulations?

FMCSR 390.3 General applicability.

390.3(a) states the rules in subchapter B of 390.3 are applicable to all employers, employees, and commercial motor vehicles, which transport property or passengers in interstate commerce.

Again, you can see from 390.3(a), applicability of the Federal Motor Carrier Safety Regulations is broad. They are meant to cover as much of the trucking industry as possible.

FMCSR 390.3(e)(1) states every employer shall be knowledgeable of and comply with all regulations contained in this subchapter which are applicable to that motor carrier´s operations.

In sum, the FMCSA has made it clear in 390.3(e)(1) it requires all employers to know and comply with all applicable Federal Motor Carrier Safety regulations. The regulations are not guidelines, they are a detailed set of laws the truck companies must follow. It is not an option. If you operate as a motor carrier you are required to know and follow the laws. Indeed, when the laws are followed, there are less St. Louis truck accidents on our roadways.

390.3(e)(2) states every driver and employee shall be instructed regarding, and shall comply with, all applicable regulations contained in this subchapter.

The FMCSA makes clear in 390(e)(2), the motor carrier has an obligation to make sure its employees know and follow the regulations. If the truck company and/or the truck driver fail to follow the regulations, fines and penalties can be imposed.
