Faulty GPS Instructions Lead to Product Liability Suits
New inventions and products replace their outdated counterparts on shelves everyday. Every new product offered to the public is required to go through numerous tests and trials to make sure each is reasonably safe for consumers. Testing can only find so many faults in a product, and years and years of use may reveal that even reasonably safe products can become hazardous with exposure to certain conditions and situations over time.
When a product has been found to be dangerous, the manufacturer is required to remove the product from public outlets and issue a recall to prevent as many injurious situations as possible. In the meantime, however, many consumers may not be aware of the recall and may encounter perilous situations through product use. When a product has injured a customer, he/she may be able to sue for injuries through a products liability claim.

New technologically-advanced products, including electronic devices like global positioning systems (GPS), have recently given rise to product liability issues. Although said items may convenience thousands of users everyday, they can also create dangerous situations.
The systems, which transmit signals to determine product location and spatial relations, are mainly used to help drivers with directions. GPS devices often times use voice commands that detail the easiest route to get to the user’s chosen destination.
Recently, GPS devices have been questioned for safety, as several car accidents have been blamed on actions commanded through the electronic device. More specifically, several train accidents have been blamed on the relatively new product. Although the reported railroad accidents were nonfatal, the incidents are bringing about questions and concerns about the device’s safety, accuracy and reliability.
Two accidents in 2008 that occurred in Westchester County, New York have been blamed on the transportation tool. In both instances, each respective driver was told by their global positioning systems to turn right as they crossed over railroad tracks. In both instances, the driver’s’car got stuck on the railroad tracks, and the drivers had to abandon their cars to avoid being hit by a train. The cars were completely demolished when trains slammed into them at approximately 60 miles per hour.
The consumers both claim they did exactly what the device told them to do and did not think twice before acting on the driving commands given, as the devices had previously been helpful in providing sound directions. Both drivers, although not physically injured, believe the damages sustained were caused by the product’s faulty instructions.
Instances, such as these, have given rise to additional concerns about other injurious situations that could be caused by incorrect GPS directional advice. For instance, a situation could arise if the GPS has not been updated on new construction zones or advises drivers to make u-turns in illegal situations.
When using any product, especially new tools and gadgets recently introduced to the market, it is important that you exercise caution. Even though both drivers in the cases above attribute their accidents to directions given by their GPS, it is likely the incident could have been prevented if the driver was paying full attention.
You should always pay attention to your surroundings and try to prevent dangerous situations. However, when a situation is out of your hands and a product causes you injury, it is in your best interest to contact a personal injury lawyer as soon as possible to help with your injury claim.
