Motorcycle Accident Injuries Contested by Insurance Company
Motorcycle accident statistics reveal that approximately 5,000 people are killed in motorcycle crashes every year. Saint Louis, MO has their fair share of motorcycle accidents. Some suggest it is due to the Missouri seasonal weather changes.
Additional important findings include:
- One-fourth of motorcycle accidents are single vehicle accidents
- Missouri roadway defects (potholes, for example) account for less than ten percent of accidents, a moderate amount of single-vehicle motorcycle crashes
- Over 90 percent of motorcycle riders involved in an accident were self-taught and with little experience
A recent motorcycle accident is representative of these factors. It was a single vehicle accident, involving a road defect and an inexperienced motorcyclist. In this Washington motorcycle accident a man was driving his motorcycle with his wife as his passenger. They were traveling on a hard-surfaced portion of the highway when the man decided to pull off on the shoulder. However, he did not realize the road was recently under construction and that the surface was not level.
The man, upon realizing the uneven surface, tried to stop the motorcycle but the surface was covered with loose gravel. When he applied the brake the motorcycle had difficulty coming to a halt and the bike dropped violently to the ground. Both the man and his wife fell along with the bike due to the hazardous roadway.
Tey both sustained severe injuries during the motorcycle accident. The woman suffered severe shoulder injuries and the man suffered extensive injuries to his ankle. The woman now suffers from a “frozen shoulder” that requires routine and extensive medical treatment, in addition to physical therapy and acupuncture.
The couple’s motorcycle insurance company was hesitant to provide compensation for all the damages alleged in the injury motorcycle accident. The hesitation by the insurance company created great stress for the couple. A motorcycle accident lawsuit was filed. The couple recovered the full amount of the insurance policy.
The insurance company appealed the judgment. The motorcycle insurance company argued the compensation was excessive and the woman’s injuries were not investigated thoroughly enough.
The court ultimately found the trial court was not in error as the evidence clearly supported the findings in the initial suit.
This case shows that insurance companies are often reluctant to pay the full amount of their policy following a motorcycle accident. It is important to remember, Insurance companies have aggressive lawyers working on their side. They are quick to send investigators to the motorcycle accident scene after a wreck to collect as much evidence for their side as they can. You need an injury lawyer to do the same for you.
